Halal Product Assurance Law Updates
📌 The validity period for the Halal Certificate has been removed following the amendment of Law Number 33 of 2014 by Law Number 6 of 2023 concerning the Establishment of the Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation.
🛡️ Since there is no time limit for the certificate, comprehensive and continuous supervision is crucial to ensure products consistently meet Halal Product Assurance (JPH) standards.
📖 The JPH supervision guidelines are essential for ensuring uniformity in perception and action among all JPH supervisors across different regions.

Principles of Halal Product Supervision
⚖️ Supervision must be independent, free from external influence or pressure, and objective, based purely on facts without personal bias.
🤝 Supervision requires accountability and transparency, reporting to the public according to prevailing laws, and fulfilling responsibility to God (Allah SWT).
⚡ The process must be effective and efficient, aiming for appropriate utility while minimizing resource use through speed, simplicity, and low cost.
🎓 Supervisors must operate professionally, prioritizing expertise based on competence and adhering to the code of ethics.

Scope of Halal Product Supervision (PP 42/2024)
🔍 Scope includes supervision of the product itself (materials, production process PPH) and the business actors.
📜 Oversight extends to Halal Examining Institutions (LPH), ensuring auditors perform their checks correctly, and supervision of Halal Labels and the notation of non-halal elements.
🏭 Supervision also covers pendamping PPH (PPH facilitators) and the overall segregation of production, storage, distribution, and sales locations.

Types and Stages of Supervision
📅 Supervision occurs in two types: periodical surveillance, ideally conducted every 6 months based on available budget conditions, and ad-hoc surveillance conducted as needed, such as when violations or public reports arise.
📝 The supervision stages involve planning (determining the product type, e.g., food, cosmetics, chemicals), implementation (conducting checks on process, label, LPHs), and reporting.
🛑 Following implementation, supervisors must create a report containing recommendations that may lead to administrative sanctions, including written warnings, fines, product withdrawal, or certificate revocation.

Duties, Obligations, and Authorities of JPH Supervisors
📋 Key obligations include planning surveillance, conducting document review and/or field inspections (accessing production sites), and carrying official assignment letters and identification.
📄 Supervisors must compile the Minutes of Inspection Results (Berita Acara) and formal recommendations, while maintaining the confidentiality of supervision results.
🔎 Authorities granted include the power to examine and collect data, information, and documents (including photos/videos), and the right to enter production facilities related to PPH.
🧪 Supervisors are authorized to take samples of materials and/or products for laboratory testing and provide recommendations for improvement.

Key Points & Insights
➡️ The removal of the Halal Certificate validity period mandates stricter and continuous supervision mechanisms.
➡️ Supervisors must rigorously adhere to the principles of independence, objectivity, and professionalism in all inspection activities.
➡️ Supervisors are obligated to carry official assignment letters and submit formal reports, including recommendations for potential sanctions, as their work lacks output without documentation.
➡️ Supervisors have the authority to access production facilities and collect material/product samples for mandated laboratory testing.
